Knowledge Pack — KSA Immigration: Iqama and Residency

Overview

Saudi Arabia operates a sponsorship (kafala) system in which foreign nationals' right to reside and work in KSA is tied to a sponsor — typically their employer. The iqama is the physical residence permit card that foreign nationals must hold to legally reside in KSA.

2021 labour reforms have significantly restructured the kafala system, giving workers greater mobility while maintaining the employer-sponsor framework for visa and residency purposes.

The Iqama (Residence Permit)

Feature Detail
Issued by General Directorate of Passports (Jawazat)
Linked to The sponsor (employer or family member)
Validity 1–2 years; renewable
Electronic card Iqama replaced by electronic ID card (Hawiya) with embedded iqama data
Mandatory All foreign nationals residing in KSA more than 90 days must hold a valid iqama
National ID equivalent Iqama serves as the primary ID document for foreign nationals in KSA

Iqama Issuance Process

  1. Employee arrives on work visa (sponsored by employer).
  2. Employer initiates medical check at approved hospital.
  3. Fingerprint biometrics + photo at Jawazat.
  4. GOSI registration initiated.
  5. Iqama card issued within 2–4 weeks.

Iqama Fees

  • Employer pays SAR 400/month (approximately) per expatriate employee as a "iqama levy" (رسوم الاقامة) — this is a significant cost for large expatriate workforces.
  • Additional dependent levies for each family member.
  • Fee schedule updated by the Ministry of Interior; verify current rates.

Employer Obligations as Sponsor

The employing sponsor bears legal responsibility for:

  • Keeping the iqama valid (renewal before expiry).
  • Exit and re-entry visa issuance (historically required employer approval; reformed 2021 — see below).
  • Final exit visa on termination — must be arranged.
  • Maintaining insurance for the employee.
  • Registering the employee on Qiwa platform within 30 days.
  • Reporting overstays or abandonment to MOI.

Failure to renew the iqama: both employer and employee may be fined. Employee may be arrested and deported; employer may face suspension of visa quota.

2021 Kafala Reform: Worker Mobility

Royal Decree reforms (2021, implemented via HRSD Ministerial Decision) introduced significant changes:

What Changed

Feature Pre-Reform Post-Reform
Job change Required employer NOC (No Objection Certificate) Workers can change employer after 1 year without employer consent (most categories)
Exit re-entry permit Required employer signature Abolished for most workers — workers can exit and re-enter without employer approval
Exit without return Required employer signature Abolished for most workers
Final exit Required employer approval in many cases Employer must facilitate; Qiwa process
Domestic workers Excluded from reform Still under Kafala with less protection

Conditions for No-NOC Job Transfer

  • Minimum 12 months continuous employment with the current employer.
  • No active labor complaint between parties.
  • Transfer processed via Qiwa platform by the new employer.
  • Employer may seek compensation if employment contract has a specific notice or non-transfer clause — legal validity debated.

Who Is Excluded from Full Reform

  • Domestic workers (maids, drivers, gardeners): remain under traditional kafala.
  • Workers in strategic or sensitive sectors: certain government/defense-linked roles.
  • Workers under documented disputes or with financial obligations to employer.

Premium Residency (Saudi Green Card)

The Premium Residency Permit (PR) was introduced in 2019:

Type Annual Fee One-Time Fee Key Benefits
Permanent Premium Residency SAR 800,000 Permanent; self-sponsorship; no employer dependency
Temporary Premium Residency SAR 100,000/year Annual renewal; self-sponsorship; renewable

Benefits

  • Self-sponsorship: no employer sponsor needed for residency.
  • Can own real estate in Saudi Arabia (designated areas).
  • Can operate commercial businesses without Saudi partner in certain sectors.
  • Dependent family members included.
  • Freedom to change jobs without Qiwa NOC process.

Eligibility Criteria

  • Financial ability to pay fees.
  • Clean criminal record.
  • Valid Saudi or international health insurance.
  • No security objections.
  • Application via PR portal (Iqama Premium).

Visas: Key Types

  • Dependents issued separate iqamas linked to the sponsor.
  • Each dependent subject to dependent levy (SAR 400/month as of recent rates; verify).
  • Wives can sponsor certain categories in some circumstances, but this is generally the husband's responsibility.

Violations and Penalties

Violation Penalty

Working without valid iqama Criminal fines; deportation
Working for non-sponsor (illegal second job) SAR 10,000 fine; deportation

Employer failing to renew iqama SAR 200–500 fine per month of delay

Amnesty Programs

KSA periodically runs immigration amnesty programs (most recently 2022–2023) allowing undocumented residents to regularize status or depart without penalties. Timing and scope vary; advise clients with irregular status to monitor HRSD/MOI announcements.

Practical Notes for Employers

  1. Visa quota management: employers must have an approved foreign worker quota (HRSD); quota determines how many foreign workers can be recruited.
  2. Qiwa compliance: all employment contracts for foreign nationals must be on Qiwa.
  3. Mudad (WPS): salary payment compliance affects iqama renewals — late payment can trigger penalties.
  4. Nitaqat: Saudization ratio affects ability to renew or obtain new expatriate visas (see [[kb-employment-law-ksa]]).
  5. High-value roles: specialized skills workers may obtain faster visa pathways through targeted sector programs (e.g., NEOM, technology, healthcare specialists).

Caveats & Currency

Immigration rules in KSA are subject to frequent ministerial decisions and online portal updates. Iqama levy rates, visa fees, and premium residency criteria have changed multiple times since 2019 and continue to be adjusted. The 2021 kafala reforms are being implemented incrementally — verify current Qiwa procedures for no-NOC transfers. Domestic worker rules remain largely unreformed; international human rights standards not fully met for that category.
